
The Delhi High Court has set aside a divorce decree passed without recording any evidence and relying on non-existent legal provisions.
The Court noted that repeated procedural lapses by Judge Harish Kumar, who cited an imaginary “Section 28A” of the SMA while deciding a petition under the HMA.
The Bench directed mandatory refresher training at the Delhi Judicial Academy, emphasizing that heavy caseloads do not excuse ignoring statutory requirements.
A fresh trial will now be conducted before the Principal Judge, Patiala House.
