Delhi High Court orders State to fill vacancies in Mental Health Authority

The Delhi HC  has directed the GNCTD to expedite filling the posts of non-official members of the Delhi Mental Health Authority and establish the Review Boards under Sections 73 and 74 of the Mental Health Care Act, 2017.

The court clarified the Model Code of Conduct for the upcoming Delhi elections must not be hindered the Constitution of the Delhi Mental Health Authority and the Review Boards. The Court granted petitions to Amit Sahni and Shreyus Sukhija to revive their petitions if the GNCTD fails to comply with its directions.

GNCTD informed the Court that seven ex-officio members have been appointed and an advertisement for non-official members under Section 46(1) of the Act will be issued soon.
