Delhi High Court passed John Doe order protecting the IPR of Rahul Mishra

The court passed ex-parte ad-interim injunction restraining unknown defendants and others from infringing trademark and artistic work, directly or indirectly, of leading Fashion Designer Rahul Mishra.

The order came after noting that the unknown defendants were infringing the trademark and artistic work of the fashion designer through its website and were also selling counterfeit dresses at low cost.

The court prima facie noted the designer’s ownership in copyright in the designs of the dresses under the Copyright Act, 1957. It also directed the Domain Name Registrar to lock and suspend the impugned website.
