Delhi High Court Restrains Questsole from Imitating Crocs’ Patented Footwear and Marks

The Delhi High Court has granted an ex parte interim injunction restraining Questsole and its proprietor from manufacturing, advertising, or selling clog-style footwear and shoe charms identical to Crocs’ patented and trademarked products. 

Crocs contended that Questsole replicated its patented system for attaching decorative accessories and used deceptively similar marks such as “Crocks,” “Croc,” and “Jibit” to promote products through Crocs’ imagery and keywords.

Finding prima facie infringement of both trademark and design rights, the Court held that non-interference would cause irreparable harm to Crocs’ goodwill and proprietary interests.

The injunction extends to Questsole’s website, associated domains, and listings on third-party e-commerce platforms.
