Delhi High Court Quashes BlackBerry Patent Rejection Over Mechanical Order

The Delhi High Court has reprimanded the Assistant Controller of Patents & Designs for rejecting BlackBerry Limited’s patent application via a cut-and-paste, template-based order.

Justice Sanjeev Narula observed that the order lacked adequate reasoning and did not demonstrate proper application of mind, stressing that patent rejections must clearly articulate the grounds to uphold principles of natural justice.

The Court quashed the impugned order and directed a fresh examination by a different officer, instructing that the patent application be considered with detailed reasoning.
