Delhi High Court Seeks Centre’s View on PIL Challenging RTE Tuition Ban

The Delhi High Court has entertained a Public Interest Litigation challenging Section 28 of the Right to Education Act, 2009, which prohibits school teachers from engaging in private tuition.

The petition, filed by a retired teacher, contended that inadequate education standards in schools compel students to seek private coaching and argued that the restriction on teachers is unreasonable.

The Court held that non-implementation cannot invalidate a statutory prohibition, rejecting the claim that the provision should be repealed merely because it is rarely enforced.

The Bench sought responses from the Union and Delhi Governments on the issue before further consideration.
