Delhi High Court Refers ‘Pind Balluchi’ Trademark Dispute to Arbitration

The Delhi High Court set aside a commercial court order that had refused to refer a dispute over the use of the ‘Pind Balluchi’ mark to arbitration.

JS Hospitality Services had filed a suit alleging unauthorised use, while Triom Hospitality relied on a June 2022 MoU containing an arbitration clause and sought reference under Section 8 of the Arbitration and Conciliation Act, 1996.

The Court held that the commercial court exceeded its scope by undertaking an evidentiary inquiry into the alleged forgery of the MoU at the referral stage. 

It referred the parties to arbitration.
