
The Delhi High Court refused to quash proceedings against a man accused of sexual offences against his minor wife, observing that the court cannot make exceptions for “near-majority consensual relationships” under the POCSO Act.
The Court emphasized that marriage, cohabitation, birth of a child, or the victim’s current no-objection cannot legalize conduct involving a minor.
The Court noted that since sexual intercourse with a person below 18 years is a punishable offence under the POCSO Act, and the proceedings must continue.
