The Delhi High Court ruled that in a rape case involving a false promise of marriage, the accused cannot claim that the victim should have expected a future refusal to marry due to their age difference.
The Court held such arguments patriarchal and legally flawed.
Citing the Supreme Court's decision in Anurag Soni v. State of Chhattisgarh, the Court emphasized that consent obtained through deception is invalid under Section 90 of IPC.
In this case, a man allegedly coerced a woman into a sexual relationship under false marriage assurances. Finding prima facie evidence, the Court rejected his plea to quash the case, allowing the trial to proceed.
