Delhi High Court Refuses to Entertain PIL Challenging BNS Provisions on Offences Against State

The Delhi High Court declined to entertain a PIL challenging provisions of the Bharatiya Nyaya Sanhita (BNS) related to offences against the State and public tranquillity.

The bench said it could not direct Parliament to amend laws, calling such action beyond the Court’s jurisdiction.

Petitioner Upendra Nath Dalai, appearing in person, argued the provisions violate Articles 14, 19, and 21 and undermine democracy.

The Ministry of Home Affairs was named as a respondent. The Court maintained that legislative powers rest solely with Parliament and dismissed the plea at the admission stage.
