The Delhi High Court set aside a 2012 IPAB order that had cancelled Indian businessman Vidya Bhushan Jain’s trademark rights over “ELFY,” an adhesive brand.
Pakistani national Mohammed Younus Sheikh had claimed prior use of the mark since 1981 and accused Jain of copying the brand and logo.
The case remained pending for years, & Jain passed away during COVID. Sheikh stopped appearing after 2019.
As Jain’s trademark remained valid until 2027 and the opposing party was unrepresented, the Court ruled in Jain’s favour and disposed of the case, cancelling the 2012 rectification order.
