
The Delhi High Court has restrained Rupa Publications India Pvt. Ltd. from manufacturing, publishing, selling, or advertising their red-and-black “coat-pocket” edition of the Constitution, after finding it deceptively similar to Eastern Book Company’s (EBC) edition.
Justice Manmeet Pritam Singh Arora observed that Rupa had copied the colour scheme, text font, gilt edging, and embossing, resulting in a strong likelihood of confusion among consumers.
The Court ordered Rupa to recall unsold inventory and delist from e-commerce platforms, and stay prohibited from dealing in the contested edition pending further hearing.
