Delhi High Court Revives Inventor’s Patent Application for Mechanical Folding Device

The Delhi High Court has set aside a Patent Office order rejecting inventor Resham Priyadarshini’s patent application for a mechanical device used to fold or bend articles.

Justice Manmeet Pritam Singh Arora held that the rejection was based on an incomplete reading of the claims, drawings, and specifications. 

The Court found that the conclusions on lack of clarity and absence of inventive step were unreasoned, contradictory, and failed to properly engage with the material on record.

Observing that such deficiencies vitiated the decision-making process, the Court remanded the matter to the Patent Office for fresh consideration in accordance with law.
