Delhi High Court Says Ex-Servicemen Availing Age Relaxation Cannot Claim Unreserved Posts

The Delhi High Court held that ex-servicemen who avail age relaxation in recruitment cannot seek consideration against unreserved (UR) vacancies, even if they secure higher marks than shortlisted UR candidates.

The Court said a candidate who enters the selection process by relying on a category-based concession cannot later claim treatment as an unreserved candidate.

Since the petitioners had crossed the upper age limit for UR posts and participated only due to age relaxation, they were ineligible for UR consideration.

Relying on Department of Personnel and Training instructions, the Court dismissed the plea challenging their exclusion from recruitment by the Airports Authority of India.
