
The Delhi High Court has issued notice on a petition seeking recognition of same-sex partners as their medical representative and to give consent in medical situations.
The plea, filed by Arshiya Takkar, challenges existing consent rules that allow only spouses, parents, or guardians to make medical decisions, excluding LGBTQ+ partners.
The petition argues this violates Articles 14, 15, and 21 of the Constitution. It requests either the framing of new guidelines or recognition of medical power of attorney for same-sex couples.
The Court has sought responses from the Union Ministries of Health, Law, Social Justice, and the National Medical Commission.
