
The Delhi High Court has referred a trademark dispute between Kushmanda Power Limited (KPL) and Ola Electric to mediation under Section 12A of the Commercial Courts Act, 2015.
KPL alleged that Ola Electric infringed its trademark rights by using the term “Bharat Cell” for lithium-ion batteries.
Justice Saurabh Banerjee noted that neither party currently holds a registered trademark—KPL’s application is under opposition, while Ola’s is at an early stage of processing.
The Court directed both sides to attempt an amicable settlement through the Court’s Mediation Centre and listed the matter for further hearing in August.
