The Delhi High Court has overturned a 2017 Central Information Commission (CIC) order that compelled Delhi University to release information related to Prime Minister Narendra Modi’s degree.
The CIC had directed the disclosure of the list of students who passed the Bachelor of Arts (BA) programme in 1978, the year PM Modi is said to have graduated.
Justice Sachin Datta allowed the university’s appeal, stating that the university holds such records in a fiduciary capacity and is not obligated under the RTI Act to make them public.
The Court emphasised the privacy protection recognised under Article 21 and agreed with Solicitor General Tushar Mehta's argument against unfettered access under RTI.
