Delhi High Court Sets Aside Registry Directive on Execution Petitions Below ₹2 Crore

The Delhi High Court has set aside a 2016 administrative order of its Registry that barred filing of execution petitions in money decrees valued at ₹2 crore or less.

The Court held that litigants cannot be denied access to courts at the filing stage through administrative directions.

A Division Bench clarified that while the Registry may raise objections on jurisdiction, it cannot refuse to register petitions. The question of maintainability must be decided judicially by the concerned judge.

The ruling reinforces that access to justice cannot be curtailed by procedural or administrative thresholds.
