Delhi High Court Sets Aside Rule Blocking Inter-College Migration of MBBS Students

The Delhi High Court struck down Regulation 18 of the Graduate Medical Education Regulations, 2023, holding that a blanket restriction on inter-college migration of undergraduate medical students is manifestly arbitrary and ultra vires Article 14 of the Constitution.

The case arose from a petition filed by a medical student with 40% visual impairment whose request for migration on medical grounds was denied by the National Medical Commission.

The Court found no rational basis for eliminating migration even in exceptional cases, underscored the obligations under the Rights of Persons with Disabilities Act, 2016, and directed the NMC to reconsider the student’s request and frame a policy permitting migration.
