Delhi High Court Sets Aside Order on Pay Commission Implementation

The Delhi High Court set aside a single-judge order mandating private schools to implement the Sixth and Seventh Central Pay Commission recommendations and pay corresponding salaries and benefits to staff.

A Division Bench held that the single judge overlooked crucial arguments concerning teachers’ eligibility, appointment modes, and schools’ rights to revise fees.

The Bench ruled that judicial functions could not be delegated to committees formed to decide teachers’ claims and directed that the matter be remanded for fresh adjudication. 

The Court emphasised that such committees could only assist the Court by furnishing reports, not adjudicate disputes.
