Delhi High Court Stays CDSCO’s Prosecution Order Against IndiaMART Over Alleged Illegal Drug Listings

The Delhi High Court has stayed the Central Drugs Standard Control Organisation’s (CDSCO) September 1 order initiating prosecution against IndiaMART for allegedly listing illegal drugs on its platform.

Justice Saurabh Banerjee directed that the order remain in abeyance until September 17, after CDSCO’s counsel agreed not to act on it before the next hearing.

IndiaMART contended that it is only an intermediary under the IT Act and enjoys safe harbour under Section 79.

The company asserted that it functions akin to a “yellow pages,” with no involvement in the manufacturing, sale, or distribution of drugs.
