The Delhi High Court held that a tenant cannot shift from one forum to another by introducing new or conflicting pleas during eviction proceedings.
The Court opined that allowing such acts would lead to endless litigation, particularly under the Delhi Rent Control Act.
The Court was hearing a tenant’s plea challenging an Additional Rent Controller’s order that cancelled his application for leave to defend against the landlord, who sought eviction to run a business.
Dismissing the plea, the Court directed the tenant to hand over peaceful possession of the premises immediately.
