
The Delhi High Court is examining whether OpenAI’s use of ANI’s news content to train ChatGPT constitutes copyright infringement under Indian law.
ANI, in its petition, argued that OpenAI unlawfully utilizes its copyrighted material for AI model training. OpenAI countered that since its data storage and training processes occur outside India, the Indian Copyright Act does not apply as it does not have extra-territorial application.
Justice Amit Bansal is assessing key legal aspects, including jurisdiction, copyright infringement, and fair use under Section 52 of the Copyright Act, 1957.
The matter remains under consideration for further hearings.
