
The Delhi High Court upheld an interim injunction restraining Leayan Global Pvt. Ltd. from using the mark “POWER FLEX” for footwear, holding it infringed Bata’s registered trademark “POWER.”
The Court noted that there was a likelihood of consumer confusion, observing that an average buyer could assume “POWER FLEX” to be a sub-brand of Bata’s registered trademark “POWER.”
While permitting use of the tagline “THE POWER OF REAL LEATHER”, the Court directed that no undue prominence be given to the word “POWER.”
