Right to Speedy Trial Cannot Be Diluted Simply Because Case Falls Under Special Law Like MCOCA: Delhi HC

The Delhi High Court has granted bail to a man jailed for nearly nine years under the Maharashtra Control of Organised Crime Act (MCOCA), citing violation of his right to life and liberty under Article 21.

The Court noted that despite serious charges like murder and kidnapping, only a few witnesses had been examined, with no sign of a timely conclusion.

Relying on Satender Kumar Antil and Mohd. Muslim, the Court held that Section 21(4) of MCOCA cannot override constitutional protections when prosecution delays trials. Bail was granted with strict conditions.
