Delhi State Commission Orders FIITJEE to Refund Fees

Delhi State Commission Orders FIITJEE to Refund Fees

  • Case Name: FIITJEE vs. Rajeev Luthra
  • Judge(s): Justice Sangita Dhingra Sehgal, J.P. Agrawal

The Delhi State Consumer Commission upheld the district commission's order directing FIITJEE to refund 50% of the ₹1,34,015 course fee and pay ₹20,000 for causing inconvenience.

The complainant’s daughter discontinued a two-year course due to academic pressure, but FIITJEE refused to refund the fees, citing non-refundable clauses.

Citing Islamic Academy of Education vs. State of Karnataka (2003), the bench emphasized that institutes must only use semester-specific fees and deposit the rest in fixed accounts, which FIITJEE failed to prove.

The commission found the institute deficient in service and ruled that students are entitled to refunds for unused services.
