The Delhi Trademark Office recently approved the application for the mark ‘CHUTIYARAM’ under Class 30 of the Trade Marks Act, 1999.
Senior Trademark Examiner Balaji noted that since no one appeared for the fourth hearing and the mark had no direct reference to the applied goods, the objection under Section 9 was waived, and the mark was accepted.
However, concerns remain over how the mark bypassed the scrutiny under Section 9(2)(c) of the Trade Marks Act, which bars the registration of marks that are scandalous, obscene, or against public morality.
Following this acceptance, the mark is published in the Trademark Journal, allowing the public and interested parties to review it.
