Delhi Lawyer Opposes MS Dhoni’s “Captain Cool” Trademark, Calls It Generic

A Delhi-based lawyer has opposed MS Dhoni’s trademark application for “Captain Cool,” arguing the phrase is generic, descriptive and widely used to describe various sportspersons.

Filed under Class 41 for sports and entertainment services, the phrase was accepted by the Trade Marks Registry despite multiple objections.

The opponent contends Dhoni’s reputation alone doesn’t justify exclusivity, and there’s no evidence of consistent commercial use. Alleged procedural lapses, including late amendments and pending rectification issues, were also raised.

Since the term is frequently used in sports commentary and lacks distinctiveness, the matter will now proceed under opposition proceedings under Section 21 of the Trade Marks Act, 1999.
