ED Must Mention Predicate Offence Details in PMLA Summons: Allahabad High Court

The Allahabad HC has ruled that the Enforcement Directorate (ED) must mention details of the predicate offence while issuing summons under Section 50 of the Prevention of Money Laundering Act.

The order came in the case of Ankur Aggarwal, who was summoned by the ED without any stated offence. The court quashed the summons, allowing the ED to issue a fresh one with proper details.

The Court further ruled that if Aggarwal (petitioner in this case) appears in response to the new summons, he cannot be arrested unless he fails to comply. The ED has been given the discretion to issue a fresh notice if relevant evidence exists.
