Kerala High Court Denies Anticipatory Bail in Cyber Defamation Case, Calls for Stronger Laws

The Kerala High Court denied anticipatory bail to a woman accused of defaming another person through a video on her YouTube channel, Visal Media.

The video falsely depicted the informant as being involved in immoral activities, drug abuse, and marital infidelity.

The court observed that the Bharatiya Nyaya Sanhita (BNS) lacks provisions to effectively tackle cyberbullying and online harassment, highlighting a legal gap.

It emphasized the urgent need for stronger laws to address such offenses.

Stating that freedom of speech does not justify defamatory content, the court dismissed her plea, stressing the growing threat of online abuse and misinformation.
