
The Ernakulam District Consumer Disputes Redressal Commission has held Philips India and Bismi Appliances liable for deficiency in service and unfair trade practice for refusing warranty benefits to a consumer who purchased an LED TV.
The Commission held that the refusal to extend warranty benefits results in breach of contractual obligations. The Commission held the actions of the companies to be arbitrary and unfair and ordered them to repair the TV free of cost or refund up to 50% of the original purchase price, in case repair is not feasible.
Additionally, the Commission also ordered compensation of Rs. 15000 for the mental agony and harassment faced by the complainant, alongside Rs. 5000 for litigation costs incurred.
