Firecrackers Not Religious or Customary to Temple Rituals: Plea in Kerala High Court

  • Case Name: Venkitachalam v State of Kerala & ors

A plea has been filed before the Kerala High Court that temples in the state are violating pollution control norms by bursting firecrackers in silent zones and beyond permissible hours, violating the Noise Pollution (Regulation and Control) Rules, 2000.

The petitioner argues that most temples lack valid licences and that excessive noise breaches his Right to Life (Article 21).

Despite Supreme Court and Kerala High Court orders, authorities fail to enforce regulations.

He also warns against the misuse of judicial relaxations granted for Thrissur Pooram Temple.

He contends that fireworks in residential areas have no religious basis and pose health risks.

The plea seeks strict action to curb unauthorized firecracker use, ensuring a pollution-free environment.
