Anticipatory Bail Denied to Man Accused of Sexual Assault Despite Claim of Friendship: Delhi High Court

The Delhi High Court denied anticipatory bail to a man accused under Sections 64(2), 115(2), 127(2), 351 of the Bharatiya Nyaya Sanhita, 2023, and Section 4 of the POCSO Act.

Justice Swarana Kanta Sharma rejected the accused’s claim of a consensual relationship, holding that friendship does not license repeated sexual assault or merciless beating.

The Court noted the victim’s delayed complaint stemmed from trauma and fear, and found the allegations serious, corroborated by material on record, and observed the accused had not cooperated with the investigation, warranting denial of anticipatory bail.
