Ganja Quantity Cannot be Accurately Determined if Mixed With Leaves: Delhi HC Grants Bail

The Court noted that under the law, only specific parts of the cannabis plant qualify as “ganja,” and including other substances creates doubt.
This uncertainty affects whether the case involves a “commercial quantity,” which has stricter bail conditions.
The Court also pointed out possible issues in the sampling process, and held that such doubts were enough to grant bail at this stage.
