Gujarat High Court Denies Wife's Plea for Restitution of Conjugal Rights, Citing Mental Cruelty

The Gujarat High Court upheld the decisions of the trial and appellate courts denying a wife’s plea under Section 9 of the Hindu Marriage Act for restitution of conjugal rights.

The Court noted her admission of attempting suicide and distributing defamatory posters of her husband, claiming her husband was missing, acts of mental cruelty, and coercion.

These actions, the Court observed, amounted to public humiliation and emotional manipulation, providing a reasonable excuse for the husband to withdraw from her society.
