Merely Passing Wrong Orders Does Not Warrant Disciplinary Action: Gujarat High Court Reinstates Judge

The Gujarat High Court set aside the dismissal of judicial officer M J Indrekar, holding that the disciplinary proceedings lacked fairness and persuasive evidence.

A Bench ruled that judicial errors alone cannot justify dismissal unless misconduct or corruption is clearly proven. Justice Indrekar was dismissed for granting an ex parte injunction and ordering the release of oil tankers in a civil suit.

The Court found no persuasive proof of misconduct, noting parties had agreed to the order and it remained unchallenged. The Court found no evidence of extraneous influence or personal gain and ordered his reinstatement to judicial service.
