The Allahabad High Court denied short-term bail to a man convicted under Sections 304/34 and 323 IPC, who sought to travel abroad for Hajj from May 4 to June 16, 2025.
The Court held that the right to perform Hajj is not absolute and can be curtailed during imprisonment.
The Court noted that the convict had completed only one month of a 10-year sentence and hence, referring to Syed Abu Ala v. NCB (2024), where bail was granted after most of the sentence was served, the Court ruled that Hajj can be undertaken after completing the term.
