
The Madras High Court ruled that elderly parents can revoke gift deeds if their children fail to care for them, even without express condition in the deed.
The Case involved 87-year-old S. Nagalakshmi, who transferred her property to her son (now deceased) and his wife, expecting them to care.
However, her daughter-in-law, S. Mala failed to support her, leading the Revenue Divisional Officer (RDO) to cancel the transfer under Section 23 (1) of the Senior Citizens Act, 2007.
Upholding the cancellation, the court emphasized that caring for elderly parents is an implicit duty, and neglect justifies the revocation of such transfers.
