Bombay HC Orders Full Reimbursement to Retired Officer Who Was Denied Heart Transplant Expenses

The Bombay High Court ordered full reimbursement to retired central government officer Anirudh Nansi, who underwent a ₹22 lakh heart transplant at a non-empanelled hospital due to a lack of timely facilities under the Central Government Health Scheme (CGHS). 

A high-powered committee had earlier denied full reimbursement, citing CGHS rate caps. The Court ruled that such rigid rules cannot override Article 21 of the Constitution, which guarantees the right to life.

Declaring the refusal a "travesty of justice", the Court emphasised that life-saving surgeries like heart transplants are exceptional and merit full support.

The Centre must pay the undisputed amount within four weeks, treating the case with humane and constitutional sensitivity.
