Delhi High Court Annuls Marriage After Wife Hid She Had No Uterus

The Delhi High Court has upheld annulment of a marriage on the ground that the wife concealed the absence of her uterus.

A bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar ruled that such concealment amounts to fraud under Section 12(1)(c) of the Hindu Marriage Act, as infertility strikes at the “core expectations of matrimony.” 

The woman had argued she was unaware of her condition, but the Court noted inconsistencies in her testimony and found it “hard to believe” she never questioned the absence of menstruation until age 24.

The appeal was accordingly dismissed.
