The Himachal Pradesh High Court reaffirmed the state’s fundamental duty to ensure fair promotions and equitable treatment of employees.
Justice Satyen Vaidya highlighted that the government must follow recruiting regulations and be transparent and fair to maintain its neutrality.
The case arose when Dr. Swati Aggarwal, who completed her Senior Residency Course in June 2016 following maternity and medical leave, was disregarded in favor of Dr. Aruna, who was promoted in February 2016.
Highlighting Dr. Nikita Verma v. State of H.P., the court clarified that the quota and roster system must balance promotions and direct recruiting 50:50. Upholding Articles 14 and 16, the court directed adherence to recruitment rules.
