Himachal Pradesh High Court Grants Bail to Taxi Driver in NDPS Case

The Himachal Pradesh High Court ruled that a taxi driver cannot be held liable under the NDPS Act without evidence of conscious possession or knowledge of contraband.

The court held that the petitioner, Amarnath, had no criminal record and that there was insufficient evidence linking him to the crime.

The Court granted bail to Amarnath, arrested with two passengers after police found 1.511 kg of charas in a bag belonging to one of the co-accused.

The Court noted Amarnath’s normal conduct, cooperation with police, and prompt production of documents. Citing Supreme Court rulings, the Court held that mere presence in a vehicle doesn't imply criminal liability.
