The Himachal Pradesh High Court has temporarily restrained Eston Roman Brewery from selling its coffee-flavoured rum branded as "Old Mist" after Mohan Meakin Ltd, makers of "Old Monk Coffee", filed a trademark infringement suit.
Justice Ajay Mohan Goel found the two products similar enough to confuse consumers and potentially allow the defendant to pass off their rum as being associated with Old Monk.
The Court granted an ex parte ad interim injunction, noting that Mohan Meakin’s trademark was registered in 2022 and Eston Roman Brewery in 2023.
