
The Himachal Pradesh High Court ruled that clubbing an employee’s tenure at nearby postings to determine transfer eligibility does not violate the definition of "transfer" under statutory rules or the State Transfer Policy.
The Division Bench held that transfer guidelines are administrative in nature and not legally enforceable, citing Union of India v. S.L. Abbas (1993), to affirm that courts should not interfere with transfer orders unless they are mala fide or breach statutory provisions.
The Court overruled Anurag Chadha v. State of Himachal Pradesh (2023), upholding the Education Department’s policy and clarifying that executive actions are valid unless they breach constitutional protections like Article 14.
