Human Teeth Not a Dangerous Weapon Under Sec 324 of IPC: Bombay High Court

  • Case Name: Tanaji Shivaji Solankar and Ors v. State of Maharashtra

The Bombay High Court recently held that human teeth cannot be classified as a 'dangerous weapon' under Section 324 of the Indian Penal Code (IPC), which pertains to voluntarily causing hurt using dangerous weapons or means.

The case involved a family property dispute, where a woman alleged that the accused assaulted her, one bit her right hand, and another bit her brother’s leg when he intervened.

The Court noted the injuries were minor, and there was no use of any weapon.

Relying on Shakeel Ahmed's (2004) case, the Court clarified that human teeth do not fall within the definition of a dangerous weapon. 

Accordingly, the Court quashed the criminal proceedings.
