Husband Cannot Control Wife’s Bodily Autonomy, Her Consent is Crucial: Allahabad

The Allahabad HC dismissed a husband's plea after he secretly recorded and shared an intimate video of his wife without consent.

The Court ruled that marriage does not grant a husband control over his wife's body, privacy, or autonomy.

Justice Vinod Diwakar referred to K.S. Puttaswamy v. UOI, which recognized privacy as an intrinsic part of Article 21 of the Constitution of India, and the landmark U.S. case Roe v. Wade, which affirms bodily autonomy as a fundamental right.

The husband's actions violated Section 67B of the IT Act, 2000, which deals with the punishment for publishing or transmitting obscene material.
