Indian Civil Court Decrees Not ‘Foreign’ Under Portuguese CPC: Bombay High Court

The Bombay High Court has ruled that decrees passed by competent Indian civil courts cannot be treated as "foreign decrees" under the Portuguese Code of Civil Procedure, 1939.

The Bench directed registrars in Goa to stop insisting on High Court confirmation for such orders.

The ruling came after a registrar in Goa refused to cancel a marriage entry based on a Bengaluru divorce decree, labeling it "foreign."

The Court clarified that since Goa's liberation, the rest of India cannot be treated as foreign territory, and local laws must align with the Indian Code of Civil Procedure.
