Indian Courts Can't Be Used to Evade the Foreign Court Orders: P&H High Court

The Punjab and Haryana High Court ruled that Indian courts cannot be used as a refuge to evade legal orders issued by foreign courts.

The case involved an Australian court permitting a father to bring his child to India for a limited period; however, he failed to return the child to Australia after the approved duration. 

Justice Rajesh Bhardwaj emphasized that allowing such conduct would amount to misusing the writ jurisdiction of Indian courts to sidestep the lawful directions of competent foreign courts.

The order reinforces the judiciary’s stance on discouraging forum shopping and misuse of legal processes.
