Indiscriminate Freezing of Bank Accounts Violates Fundamental Rights: Delhi High Court

The Delhi High Court held that blanket and disproportionate freezing of bank accounts of non-accused persons is manifestly arbitrary and violates Articles 19(1)(g) and 21 of the Constitution.

Such action infringes the right to livelihood and the freedom to carry on trade and business.

The Court ruled that, in the absence of any demonstrated complicity, freezing accounts amounts to punitive action without due process.

Authorities must act strictly in accordance with law and cannot paralyse legitimate business operations of innocent entities.
