Is It Legal to Enforce Employment Bonds in India?

Yes, employment bond agreements mandating a minimum service period or imposing a financial penalty for early resignation are legally valid.

They may be enforceable if the terms are reasonable, serve a legitimate business interest, and do not amount to forced labour or an unfair restraint of trade.

Bonds linked to recovery of genuine training costs or minimum service periods can be valid, provided they are proportionate and clearly disclosed. 

However, excessive penalties, one-sided clauses, or terms that restrict an employee’s right to seek other employment are unlikely to be legally enforceable.
